In a series of recent articles, Matthew Clayton, Andrew Williams and Rasmus Sommer Hansen and Soren Flinch Midtgaard argue that a key virtue of Ronald Dworkin’s account of distributive justice, Equality of Resources, is that it provides a distribution that is continuous with the evaluations of the individuals whom it ranges over. The idea of continuity, or as Williams calls it the ‘continuity test’, limits distributive claims in at least one important way: one person cannot claim compensation from another (...) when she does not believe she is worse off than him. In this article, I challenge whether an account of distributive justice should be continuous with the evaluations of the individuals whom it ranges over. My argument is that continuity competes with another consideration, namely, correctness. An account of distributive justice should track who actually is disadvantaged, not whether individuals believe they are disadvantaged. In addition, I offer an account of how we can get closer to a correct account of who is disadvantaged based on two sources of evidence. (shrink)

Increasingly the body is a possession that does not belong to us. It is bought and sold, bartered and stolen, marketed wholesale or in parts. The professions - especially reproductive medicine, transplant surgery, and bioethics but also journalism and other cultural specialists - have been pliant partners in this accelerating commodification of live and dead human organisms. Under the guise of healing or research, they have contributed to a new 'ethic of parts' for which the divisible body is severed from (...) the self, torn from the social fabric, and thrust into commercial transactions -- as organs, secretions, reproductive capacities, and tissues -- responding to the dictates of an incipiently global marketplace. Breaking with established approaches which prioritize the body as 'text', the chapters in this book examine not only images of the body-turned-merchandise but actually existing organisms considered at once as material entities, semi-magical tokens, symbolic vectors and founts of lived experience. The topics covered range from the cultural disposal and media treatment of corpses, the biopolitics of cells, sperm banks and eugenics, to the international trafficking of kidneys, the development of 'transplant tourism', to the idioms of corporeal exploitation among prizefighters as a limiting case of fleshly commodity. This insightful and arresting volume combines perspectives from anthropology, law, medicine, and sociology to offer compelling analyses of the concrete ways in which the body is made into a commodity and how its marketization in turn remakes social relations and cultural meanings. This article draws on a five-year, multi-sited transnational research project on the global traffic in human organs, tissues, and body parts from the living as well as from the dead as a misrecognized form of human sacrifice. Capitalist expansion and the spread of advanced medical and surgical techniques and developments in biotechnology have incited new tastes and traffic in the skin, bones, blood, organs, tissues, marrow and reproductive and genetic marginalized other. Examples drawn from recent ethnographic research in Israel, the (...) Palestinian Authority and Turkey serve to cast light on the dark side of organs harvesting and transplantation. The article focuses on the dangers of the `fetishized kidney' for both sellers and buyers, for whom this new commodity has become an organ of opportunity and an organ of last resort. The bodily sacrifice is disguised as a donation, rendered invisible by its anonymity, and hidden under the medical rhetoric of `life saving' and `gift giving'. It suggests that the ultimate fetish as recognized long ago by Ivan Illich is the idea of `life' as object of manipulation. (shrink)

The utterance “I am humble” is thought to be paradoxical because a speaker implies that they know they are virtuous or reveals an aim to impress others – a decidedly non-humble aim. Such worries lead to the seemingly absurd conclusion that a humble person cannot properly assert that they are humble. In this paper, I reconstruct and evaluate three purported paradoxes of humility concerning its self-attribution, knowledge and belief about our own virtue, and humility's value. I argue that humility is (...) not genuinely paradoxical and that these puzzles do not have meaningful implications for its conceptual analyses. I instead offer error theoretical explanations of humility's apparent paradoxicality. (shrink)

Research in which participants report potentially dangerous health-related behaviors raises ethical and professional questions about what to do with that information. Policies and laws regarding reportable behaviors vary across states and Institutional Review Boards (IRB). In alcohol research, IRBs often require researchers to respond to participants who report dangerous drinking practices. Researchers have little guidance regarding how best to respond in such cases. Personalized feedback or general nonpersonalized information may prove differentially effective as a function of gender and/or level of (...) self-determination. This study evaluated response strategies for reducing peak blood alcohol concentration (BAC) among participants reporting dangerous BACs (≥ .35%) in the context of a two-year longitudinal intervention trial with 818 heavy drinking college students. After each assessment, participants who reported drinking to estimated BACs at or greater than .35% were sent either a personalized letter expressing concern and indicating their reported BAC or a nonpersonalized pamphlet that included general information about alcohol and other substances, referral information, and a BAC handout. Hierarchical linear modeling results revealed that both strategies were associated with reduced peak BAC when controlling for previous BAC. The personalized letter was more effective for women and for students who tend to regulate their behavior based on others' expectations and contingencies in the environment. This research provides some guidance for researchers considering appropriate responses to participants who report dangerous health behavior in the context of a research trial. (shrink)

Background: Professional ethical codes are an important part of healthcare. They are part of the professionalisation of an occupation, are used for regulation of the professions and are intended to guide ethical behaviour in healthcare. However, so far, little is known about the practical use of professional codes in healthcare, particularly in paramedicine. Objective: The aim of this scoping review was to determine what is known in the existing literature about health professionals’ knowledge, awareness and use of their professional codes. (...) Method: A scoping review was performed based on a six-stage framework as described by Levac et al. Six databases were searched: OVID Medline, EMBASE, EMCARE, CINAHL, ProQuest and Scopus, in September 2020. Google Scholar, Trove and Google using.gov and.org websites were also searched for grey literature. Two reviewers independently assessed study eligibility. Results: The search yielded 1162 results after duplicate removal. Thirty-nine studies remained after title and abstract review. Twenty-five articles were included after full-text review. Sixteen examined nursing, eight examined medicine and one examined both nursing and medicine. No studies were identified that examined paramedicine. Twenty-one studies were of a cross-sectional design and four studies were of a qualitative design. Conclusion: Most health professionals know the codes exist, but do not think they know the content. Despite valuing professional codes highly, healthcare professionals do not use them regularly in clinical practice. Further research is needed, and professional codes should be made useful for practice and consideration given to how codes can be written, communicated and implemented to increase their actualisation in healthcare. Research should also begin in paramedicine to identify clinician’s knowledge and use of codes in this profession. Rules and similarity refer to qualitatively different processes. The classification of a stimulus by rules involves abstract and usually domain-specific knowledge operating primarily on the target representation. In contrast, similarity is a relation between the target representation and another representation of the same type. It is also useful to distinguish associationist processes as a third type of cognitive process.

This paper is a defense of "explanatory pluralism" (i.e., the view that some events can be correctly explained in two distinct ways). To defend pluralism, I identify two distinct (but compatible) styles of explanation in paleobiology. The first approach ("actual sequence explanation") traces out the particular forces that affect each species. The second approach treats the trend as "passive" or "random" diffusion away from a boundary in morphological space. I argue that while these strategies are distinct, some trends are correctly (...) explained in both ways. Further, since neither strategy can be reduced or eliminated from paleobiology, we should accept that both strategies can provide correct explanations for a single trend. (shrink)

As a contribution to the Common Knowledge symposium on the resolution and prevention of enmity, this article concerns how enmity deforms social as well as individual personality. Societies need time and must exert significant effort, much of it intellectual, in order to recuperate: they need to recover both from harms that others have intentionally done them and from having done harm to others. Social recuperation is difficult because the tactics and standards of wartime seep into civilian and personal domestic life. (...) In contemporary American life, the proliferation of armed and gated communities, the institution of the house gun, the general acquiescence in stop-and-frisk encounters, and the incarceration in huge numbers of gang members and small-time drug dealers are examples. An inverse relationship of wartime and peacetime abuses is also apparent: behaviors associated with civilian private life are deployed during wartime as techniques with which to humiliate and torture enemy combatants. This type of mimetic effect reaches the limit of complexity when wartime abuses that mirror domestic abuses are then mirrored in their further application to domestic settings that themselves have become militarized. Is cognition an exclusive property of the individual or can groups have a mind of their own? We explore this question from the perspective of complex adaptive systems. One of the principal insights from this line of work is that rules that govern behavior at one level of analysis can cause qualitatively different behavior at higher levels . We review a number of behavioral studies from our lab that demonstrate how groups of people interacting in real-time can self-organize into adaptive, (...) problem-solving group structures. A number of principles are derived concerning the critical features of such “distributed“ information processing systems. We suggest that while cognitive science has traditionally focused on the individual, cognitive processes may manifest at many levels including the emergent group-level behavior that results from the interaction of multiple agents and their environment. This paper explores the effects of performativity on the culture of a Scottish secondary school, Lochview High School. This is set against a backdrop of the Scottish education policy context which in recent years has been heavily focused on reducing the poverty-related attainment gap, namely through the Scottish Attainment Challenge (SAC). The analysis of the empirical data is supported by a cultural and ecological framework which emphasises the interwoven and complex nature of the school system. In particular, the paper provides (...) a critique of accountability and performative agendas which often run counter to other national agendas, such as the SAC. Through observations, staff interviews (teachers and senior management), and student interviews, task-based activities and group discussions, the data suggests performative and accountability measures are inextricably woven through the education system within which Lochview is situated. Despite this, Lochview provides a case study of a school which successfully navigates competing agendas. However, it is not without its struggles, but the school community often finds rewards and benefits in the positive school culture which develops as a result of responding to the local community’s needs. The neuropathologies of the self are disorders of the self and identity that occur in association with neuropathology and include perturbations of the bodily, relational, and narrative self. Right, especially medial-frontal and orbitofrontal lesions, are associated with these conditions. The ego disequilibrium theory proposes this brain pathology causes a disturbance of ego boundaries and functions and the emergence of developmentally immature styles of thought, ego functioning, and psychological defenses including denial, projection, splitting, and fantasy that the NPS patient has in (...) common with the child. I hypothesize that during brain development between approximately ages 3 and 7 immature defensive functions and fantasies tend to be replaced by mature defenses and the inhibition of fantasy a process that depends upon maturational processes within the right hemisphere. I propose a four-tiered model of the NPS that emphasizes a multifactorial approach and includes both negative and positive, bottom up and top down, and neuropsychological and psychological factors. It is necessary that, if the world is divided into nations, conflicts should arise in which there is no strong argument against terrorism or repression. By a strong argument I mean one that would sway all minds not blindly partisan, without moral commitments that are unusual or outlandish in the modern world and with as much aversion to violence as most people have. So I do not here consider, because it is unusual, heroic and absolute pacifism, much as I respect (...) it; on the other hand I do mention Christian moral objections applying specially to terrorism because it seems somewhat outlandish even now to ignore the Christian element in our tradition.
